Wamu WKN 893906 News !

@ gumoe : kein prob....
ciao
Beautiful. The only way Weil would release a billing statement with Global Settlement in it, is if they are at the table..
July 27th hearing..
Friedman from S&C (JPM Lawyer): Your honor the parties are trying to figure out a practical way forward (parties are close) claims are related including turnover action, discovery is related. We are trying to coordinate 2004 with debtors on their terms. I think her client is forcing her to delay these proceedings on purpose...
Rosen: Advance 2004 determine cause and action exists if exists, wrap up 2004 in all cases.
JPMC is trying to drag out and control dispute to extract a more favorable settlement in their favor. (Rise in PPS= better stock swap.)IMHO
Rosen: Bad things led to undermining the value of WAMU. JPMC is delaying on purpose.
Delay Delay Delay that seems to be their tactic
Friedman: Your honor is not my fault there is a delay.
THJMW: It not all your fault.. laughter in courtroom.
Parties should be sensitive in repeating depositions. Allow 2004 in regards to Business Tort claim. #13 Order entered.
Friedman: WMI is trying to subject Senior Executives to multiple depositions and search files multiple times.
THJMW: I'll get some discovery disputes then, direct parties to scheduling orders and coordinate. get docs, time to review and try to avoid duplication
We're adjourned...

Naja wird schon noch kommen
ciao
Warum sagt's nicht mal jemand dabei?
Also: Was momentan läuft, weiss niemand genau.

ausreichen.

"In addition to the various cases, proceedings and investigations discussed above, JPMorgan Chase and its subsidiaries are named as defendants or otherwise involved in a number of other legal actions and governmental proceedings arising in connection with their businesses. Additional actions, investigations or proceedings may be initiated from time to time in the future. In view of the inherent difficulty of predicting the outcome of legal matters, b]particularly where the claimants seek very large or indeterminate damages, or where the cases present novel legal theories, involve a large number of parties or are in early stages of discovery, the Firm cannot state with confidence what the eventual outcome of these pending matters will be, what the timing of the ultimate resolution of these matters will be or what the eventual loss, fines, penalties or impact related to each pending matter may be. JPMorgan Chase believes, based upon its current knowledge, after consultation with counsel and after taking into account its current litigation reserves, that the outcome of the legal actions, proceedings and investigations currently pending against it should not have a material adverse effect"

However, in light of the uncertainties involved in such proceedings, actions and investigations, there is no assurance that the ultimate resolution of these matters will not significantly exceed the reserves currently accrued by the Firm; as a result, the outcome of a particular matter may be material to JPMorgan Chase’s operating results for a particular period, depending on, among other factors, the size of the loss or liability imposed and the level of JPMorgan Chase’s income for that period".

An "ultimate resolution" seems to me like incogneto wording for a "global settlement" and the cost of resolution, as disclosed by JPM, is going to be very favorable to us.

St Jean Cap Ferrat -- Im Exil

With $10 billion and its honor at stake, it's no wonder that JPMorgan Chase and its lawyers at Sullivan & Cromwell are scratching and clawing in the litigation over JPMorgan's firesale acquisition of Washington Mutual last fall. (As we've previously reported, WaMu's bankrupt parent company has accused JPMorgan of engineering a scheme to undermine the savings bank's assets in order to buy it on the cheap, as well as alleging that JPMorgan misappropriated $4 billion in WaMu deposits.) But a filing last week in Delaware federal bankruptcy court, in which JPMorgan seeks to compel members of an unofficial group of noteholders to identify themselves, has other folks in the litigation scratching their heads. No one would comment for the record for the Litigation Daily, but it seems that Sullivan & Cromwell may be trying to create a rift in the informal coalition that's trying to recover money from JPMorgan.
S&C referred our calls to JPMorgan; spokesman Thomas Kelly said the bank would not comment on pending litigation.
The bondholders are cooperating with both the unofficial committee of unsecured creditors (represented by Akin, Gump, Strauss, Hauer & Feld) and WaMu's parent company (represented by special litigation counsel Quinn Emanuel Urquhart Oliver & Hedges) in pursuit of billions of dollars from JPMorgan. Quinn Emanuel is leading the way, via a suit in the bankruptcy court in which Judge Mary Walrath recently granted the firm's motion to conduct discovery on JPMorgan's holdings.
JPMorgan's August 6 filing, which was first reported by The Wall Street Journal, suggests there's dissension among the noteholders. The filing requests a court order compelling each member of the so-called Washington Mutual Noteholders Group to comply with bankruptcy code rules and specify the specific amount of its claim. The filing notes that the group, which in October 2008 said it held $1.1 billion in WaMu notes, was first represented by White & Case, but more recent filings--in which the group claims to hold $3.3 billion in notes--have been signed by Kasowitz, Benson, Torres & Friedman.
The implication is a split in the bondholder group as it has grown. But Kasowitz partner David Rosner told The Journal that there's no such rift. He said his firm and W&C are acting as cocounsel for the noteholders. (W&C may have a conflict that precludes it from litigating against JPMorgan; W&C partner Thomas Lauria didn't return our call and Kasowitz partner Rosner was not available for comment.)
In any case, we've heard that so far, the debtors, the creditors committee, and the noteholders are working together in the case against JPMorgan. Down the road they may fight over spoils from the bank, but they've got to get the spoils first.

Timeline for settlement:
1. JPMC will push this to the last minute. They will gain a more favorable share swap by doing so. In the last couple of months their stock price has risen by $5/s.
2. They will have to settle on Weil's terms, they have no other choice. For JPMC to allow 2004 discovery would be suicide. People would go to jail, including JD himself.
3. So, how long can this drag on? They are currently in breach of a court order demanding they turn over documents by 8/1. The only thing that could possible save them from the wrath of THJMW would be a joint communication from JPMC/WMI saying they are very close to a settlement. The next Omnibus hearing is set for EOM. If we don't get a settlement by then, I think JUDGE WALRATH will begin issuing damaging orders from her bench. At this point the stalling tactic has worked, but JPMC is out on very thin ice and the cracking has already begun to be heard around the world. I give it two weeks, no more than that.

While I would not invest in the equity of the vast majority of Chapter 11 cases (and would be very cautious about their debt), I have no such concerns here. The A/L has established that WMI bonds and WAHUQ are covered, and the absolute certainty of recovery for all equity classes was, in my opinion, established on March 20, 2009 when WMI satisfied the statutory deadline of complying with 1821(d) by filing its lawsuit. Afterwards, a far less competent law firm could have brought JPM and the FDIC to heel, but having Weil and Quinn fighting for WMI assures a maximum recovery (i.e., well above 1x book value).

Für mich ein gutes Zeichen. Es kommt nun Schwung in die Sache.
