leechungsr, or should I say leech.... participating here requires some work... but here's three links for you to work from...

That's about as much spoonfeeding as I'll do ;)
Keep in mind that occasionally some of the bashers will make up aliases which "include" the word bopfan, etc. Make sure you're looking clearly at the "author" column to ensure you're reading the posts from the correct authors.

I think JPMC knew from the beginning that $1.9B was a ridiculous offer and a settlement would be forth coming. I also think JPMC was in financial trouble and the assets from WAMU would shore up a company that "was too big to fail". Having done it this way they have snared the FDIC to pick up more than half of the settlement. Which was probably a deal concocted last summer between Sheila and Jamie. This now gives the FDIC a green light to give JPMC around $30-$35B outright under the guise of settling a deal with WAMU. Oh, the money will be part of the settlement, however, JPMC will end up with a $300B company and all of their assets for around their original low-ball offer of $8/s. The FDIC will bring it up to $24/s as their part of settlement. It was collusion pure and simple. No one will get caught. A settlement will protect all evil doers. It will appear to the pubic that the FDIC is just doing their job and that JPMC helped clean up a financial mess.

Re: New Filing In Adversary Proceeding - WMI Withdraws Request For Sanctions
Gibson:
The more I think about it, the more I agree with both points you make here, and the more it appears these ideas could have additional significance.
(1) If JPM really does intend to eventually settle with a stock swap, which I think everyone (even Bop) admits is the cleanest resolution of a very complex scenario (think about the $4B cash, the NOLs, the subs, the tax refunds, the intellectual property, etc.), then it's a no-brainer to delay as long as possible for stock market value to maximize and stabilize.
(2) Plus, the one year anniversary has concrete legal significance as between JPM and FDIC because their P&A contract prohibits FDIC's ability to come back and change the terms of the contract after one year.
This creates a potential two step scenario where WMI and JPM cut their own deal ("global settlement") after Sept. 25th, leaving FDIC out of the deal (and in a ditch by the side of the road), thereby resolving their adversarial proceedings against each other, but leaving WMI free to pursue the DC action against the FDIC for unconstitutional taking, negligence, etc. with JPM no longer being a party to that action, but perhaps in fact cooperating with WMI's attorneys! (What's more, by then FDIC should be fully funded with their new-found congressional largess and have fewer bad banks to worry about, and so be better able to cut a deal with WMI.) As long as JPM plays their cards very close to the vest, such as by continuing to appear to the FDIC to be to be really, honestly fighting WMI tooth-and-nail on every issue, FDIC really has no power to stop them. (If they tried to change the terms of the P&A now they would be admitting they made a mistake.) When FDIC finally figures it out it will be too late. Perhaps this helps explain WMI's "soft" position of the discovery deadlines, etc. This scenario may be a part of a backroom deal already made between WMI and JPM and what we've been seeing lately is just a carefully orchestrated dance intended to convince FDIC that their still fighting.
Hoping I'm right, GLTA.

Was er sagt, geht in meine Denkrichtung:
I think the term "global settlement" would include all parties. I can't see getting a piece-meal settlement. I am also wondering if Weil et.al. has rejected a stock swap settlement from JPMC and is holding out for cash. If the FDIC kicks in $30B cash and JPMC keeps $4.4B cash, NOL's, $17B from WAMUfsb cash and in return gives us shares of JPMC how would that be a good deal for WAMU? If we come away with $52B cash we can write our own ticket. Reorganize or choose from many offers which would be sure to come from interested parties hungry for the cash.
Gib, Are you suggesting the prospect that a settlement might result in JPM simply "giving" WMI sufficient shares to match the settlement agreement?
For instance, (for sake of ease of math) if the settlement agreement was $50B, then with JPM selling at $50 per share, JPM would simply award WMI 1B shares of JPM stock?
Well, I think that's what you're saying.
If that happened, JPM's outstanding shares would go from 3.93B to 4.93B and WMI would own over 25% of JPM. That would seem to me to be a troubling prospect for JD -- that an outside entity with it's own board of directors and entire corporate structure would represent such a large voting block of JPM.
Considering the negativity of that prospect (Well, if I were JD, I'd consider it ugly in the extreme), I don't understand how such a scenario would benefit JD or JPM.

Further, if WMI were then able to subsequently prevail over FDIC for even more money, JD and JPM would not benefit from that.
Personally, (and I'm willing to entertain all scenarios), I think it would be far better for JD and JPM if WMI were merged into JPM (via stock swap) as a subsidiary (and retain Wiel and Quinn), and still go after FDIC. If that happened and WMI then prevailed against FDIC, that'd a win not only for WMI, but for JPM as well. And that win (if it happened) could offset some of the settlement $$$ JPM had to fork out.
My vote still goes for a stock swap that makes WMI as an independent trading vehicle go away.
Once that's done, everybody can decide for themselves individually if they wish to retain their JPM shares or sell them and call it a day.

Speculation Sunday I like it Gib Zwinkern Obviously JPM and WMI would have to come up with a number thats satisfactory. JPM paying 50B by themselves isn't.
Weil would obviously put a number on the FDIC's culpability say the 13B plus damages (approx 20B). JPM could get say 5B from the FDIC (settlement to WMI), have the FDIC cover the 12B (14B - 1.9) in debt and future class actions. Costing the FDIC approx 20 - 25B. JPM converts the preferreds and restructures debt and swaps WMI's stock at a 3:1 ratio (at a $45 SP).
Regardless of JPM's influence over the FDIC and Bair. The OTS seized WAMU at the direction of the Government and the FDIC instantly became the responsible party. They are held responsible for the domino affect which occured. A 25B loss to cover the largest bank heist in history is still a win. JPM wins by getting WAMU cheaper than $8 a share because of all the negative goodwill, tax refunds, NOL's, cash (4.4B plus 10B from WMBfsb) earnings of 2B a QTR, 2239 branches (although FDIC kept some), IP property and so on. Once JPM receives cash from the FDIC their SP which takes a hit initially upon settlement rebounds.
Only problem with this scenario is if Mr Bonderman can put the bad blood aside and become part of JD's team?
All hypothetical and JMO.

WMI has JPM/FDIC cornered with potentilly criminal activity. There is no way in the world if I was holding WMI cards that I would sell myself to that corrupt outfit. I would demand cash/stock to pay for their part.
If JPM's part is 25 billion, I would demand 50 billion if they wanted to pay in stock to offset any dillution that WILL occur. In other words anything they want to settle with, other than cash has to be twice that amount.
You have to understand if WMI gets 24.00 cash, that means somebody is willing to pay 48.00 per share with a stock transaction; such as GS or WFC. It would be insane for WMI to sell completely to JPM for 24.00 per share; lock stock and barrel.

Da muss was passieren, und zwar etwas Substanzielles.
Gute Nacht.
But sometimes I can't resist, and since it's "Speculation Sunday", why not?
man man man.
wenn einer was weiß, auffälligkeiten da sind, auf englisch was gepostet wird, was sinn macht, bitte posten, aber bitte nicht so ein quatsch.
oli
