Law360, New York (October 17, 2012, 2:02 PM ET) -- A Texas federal judge on Monday shot down Research In Motion Ltd.'s attempt to narrow part of a patent dispute with Eastman Kodak Co., the film and photo equipment company that filed for bankruptcy early this year.

In a one-page order, U.S. District Judge Ed Kinkeade denied RIM's motion for partial summary judgment in an action the BlackBerry maker brought seeking a declaration that it did not infringe a handful of Kodak patents on camera and digital imaging technology.

F. ​Kodak v. Samsung; LG Electronics (W.D.N.Y. and ITC 2008)

Kodak began a plethora of patent infringement suits in November 2008 by suing Samsung and LG Electronics over camera patents in three lawsuits – two in district court and a third at the ITC.[24] The two patents-in-suit related to technology used for image capture, compression, data storage, and previewing images. Kodak accused LG and Samsung’s camera phones. Samsung fired back at Kodak three months later with its own complaint at the ITC, accusing Kodak cameras of infringing two patents relating to technology used in cameras, ultra-portable computers, and digital music players.[25] Samsung specifically accused more than a dozen Kodak camera models.

With respect to Kodak’s ITC suit, LG Electronics reached a settlement agreement on November 30, 2009. With Samsung as the only remaining party, the ITC on December 17, determined that Samsung infringed both patents-in-suit. After the decision, Samsung settled the case with Kodak in January 2010, which resolved all litigation between the two companies. The settlement involved a payment from Samsung to Kodak with a technology cross-license that was royalty-bearing to Kodak.[26]

G. ​Kodak v. RIM and Apple (N.D. Tex. 2008; ITC 2010)

Kodak’s dispute with RIM began when RIM filed a declaratory judgment action of non-infringement against four of Kodak’s patents in November 2008. [27] Although Kodak and RIM met numerous times regarding licensing, they were unable to reach an agreement. RIM filed its complaint in November 2008, claiming that its products did not infringe Kodak’s patents. RIM further accused Kodak of demanding exorbitant royalties. Kodak’s patents covered digital imaging technology used in camera phones, and software designed to integrate data and application programs.[28]

On January 14, 2010, Kodak responded by filing complaints against both Apple and RIM at the ITC and against only Apple in the district court.[29] The ITC complaint accused Apple’s iPhone and RIM’s camera-enabled Blackberry devices of infringement of one Kodak patent relating to image capture and color previews on digital cameras. In January 2011, the ALJ issued an initial determination that Kodak’s patent was invalid due to obviousness, but in June, the ITC panel revised the interpretation of certain claim terms and remanded for reconsideration. Although the ITC finally determined that Apple and RIM had infringed some of the claims, the ALJ found that Kodak’s patent was invalid, giving Apple and RIM a win. The decision now rests with the ITC panel, which should issue an opinion by September 2012. Kodak has claimed that a decision in its favor could help it garner more than $1 billion in royalties from the RIM and Apple.[30]

I. Kodak v. Apple (W.D.N.Y. and ITC 2010)

Kodak filed two complaints in January 2010 in the Western District of New York, charging Apple with infringement of five patents.[38] The first case alleged infringement of two patents that covered image preview technology and the processing of images of different resolutions, targeting Apple’s iPhone 3GS. In the second case, the three patents related to a method by which a computer program could ask for help from any other application to carry out certain computer-oriented functions. The second complaint accused Apple products such as the Mac Mini, the iMac, the Mac Pro, the iPhone 3GS, and the iPod Touch.

Apple struck back on April 15, 2010, filing a complaint at the ITC.[39] The suit asserted two Apple patents relating to devices for capturing multiple image bursts. The case did not touch on smartphone devices but focused on Kodak cameras.[40] On May 12, 2011, the ALJ found that Kodak did not infringe Apple’s patents. The judge also determined that the relevant claims asserted by one of the patents – the ’911 patent – were invalid. On July 18, 2011, the ITC affirmed the ALJ’s finding. The district court cases are still pending.

Kodak and SolaByte Partner to Simplify Purchase of Licensed Entertainment Content

Eastman Kodak Company, a worldwide leader in retail imaging solutions, and SolaByte, a cloud media service provider, today announced they have signed an agreement to facilitate electronic sales of copyrighted music and motion pictures through automated disc-to-digital transfer and online content purchases.

As part of this agreement, Kodak and SolaByte will develop and market solutions that utilize Kodak's global footprint of 105,000 KODAK Picture Kiosks to automate the disc-to-digital upgrade process.  The automated process identifies content stored on DVDs, CDs and BLU-RAY Discs and authenticates the disc as genuine prior to registering the license for the content to the consumer's account. The disc is digitally flagged by the system to limit the number of digital copies that can be obtained from the disc.  SolaByte's patent-pending technology eliminates the need to move large video or music files to the cloud, conserves storage space, and does not compromise the playback of the original disc.  The professionally mastered digital copies, made from the KODAK Kiosk, then may be easily used by consumers to listen to music or to watch movies online, at home, or on their portable devices.

Kodak Löst $ 1,2 Bln Renten Health-Care, Survivor-Vorteile Haftung


(RTTNews.com) - Der Fotoausrüstungshersteller Eastman Kodak Co. (EKDKQ), der die Insolvenz im Januar eingereicht hat, vereinbarte am Mittwoch über die Änderung der US-Renten Gesundheits-und Hinterbliebenenleistungen Programm, das in deutlichen Kostenreduzierung führen wird und auch die Liquidität des Unternehmens steigern wird. Allerdings sagte das Unternehmen, dass das Renten Geschäft nicht beeinflussen wird.

Die Abfindungssumme, der ein $ 1200000000 Renten-Verbindlichkeit Leistungen löst, wurde mit dem offiziellen Ausschuss der Rentner oder mit 1114 Ausschuss Mitglieder erreicht. Die Haftung wurde als große Hürde für die Kodak Pläne vor dem Konkurs hervorgehen, gesehen.

Die Rochester, New York-based, 131-jährigen Unternehmens darauf hingewiesen, dass der Deal die Unterstützung des Offiziellen Schuldners Ausschuss der unbesicherten Gläubiger hat und als einen wichtigen Schritt in Richtung die Insolvenz zu verlassen gesehen. Kodak Awards MPM SWORD iJET Gloss a 5 Diamond Rating

(TOKYO, JAPAN)  Mitsubishi Paper Mills (MPM) today announced Kodak has awarded the SWORD iJET Gloss a 5 Diamond rating on the Paper Rating Program for KODAK PROSPER Presses, the highest rating within the Paper Rating Program.  Kodak's 5 Diamond rating is awarded to a media that equates to "offset quality" within the rating structure.  MPM has collaborated closely with Kodak in the United States as well as in Japan in order to develop a product which meets such a high rating distinction.

Health care providers are rolling out several medicare retiree benefit meetings exclusively for former Kodak employees.

Eastman Kodak announced earlier this month that the company will end retiree health benefits by the end of the year.

This change or end in benefits will effect about 25,000 former Kodak workers living in the Rochester area. Kodak's retiree benefits cover medical, dental, life insurance and survivor income benefits.

Kodak's paid about $1.2 billion annually for these benefits and now all those people will need to get coverage on their own.

Companies like MVP Health Care and Excellus Blue Cross Blue Shield are working to help retirees come up with individual health care plans. Because there are so many Kodak retirees, those providers are holding benefit meetings exclusively for former Kodak workers.

These seminars will be held at various locations throughout the Rochester area. The meetings are free to attend. Previous meetings have been filled.

MVP Health Care says Kodak continues to be their customer and will continue to meet the health insurance needs of employees and retirees.

For all retirees currently covered under MVP plans, MVP will mail out information outlining health coverage options and meetings for those who are Medicare eligible. The first one is next Friday, November 2 at the Diplomat Banquet Center located at 1956 Lyell Ave. There are three sessions at 9:00 a.m, 11:00 a.m. and 2:00 p.m.

There are two more planned Friday November 9 in Gates and Pittsford.

Now, Excellus Blue Cross Blue Shield has four medicare seminars the next two weeks. The first one is today from 9:30 to 12 at the Wishing Well at 1190 Chili Ave., and Tuesday, Oct. 30 at 10:00 a.m. at the American Legion on Main St. in Canandaigua.

More are planned, for a complete list of seminars for Excellus and for MVP.

Kodak retirees have had some warning that health benefits may change since the company filed for bankruptcy back in January. Now it is crunch time to get those benefits lined up before the current coverage expires December 31.

 Die Nexpress-Druckmaschinen sind mit dem fünften Druckwerk ausgestattet, das den Einsatz der neuen Neon-Pink-, Metallic- und Perlglanz-Dry-Inks ermöglicht. Damit erhöht sich die Anzahl der bei Anton installierten Nexpress-Druckmaschinen auf neun. Darunter ist auch die  Nexpress SX-Plattform mit ihrem größeren Bogenformat.

Die jüngste Investition in Produktionstechnik von Kodak unterstützt die auf den Hybrid- und den Digitaldruck ausgerichtete Wachstumsstrategie von Anton. "Unser Einstieg in den hybriden Druck war eines der aufregendsten Projekte, an denen ich je beteiligt war", sagt John Knight, CEO der Anton Group. Die Anton Group ist ein privat geführtes Unternehmen und einer der größten Druck-, Postversand- und Fulfillment-Dienstleister Großbritanniens.

Die Anton Group realisiert mit den Prosper S5-Eindrucksystemen eine Hybriddrucklösung auf ihren Bogenoffsetdruckmaschinen. Die Systeme werden in den Heidelberg Cutstar-Rollenquerschneider integriert. Die digitalen Eindrucksysteme von Kodak ermöglichen der Anton Group den  variablen Datendruck bei der Produktion von Direktmailings mit voller Geschwindigkeit auf ihren Offsetdruckmaschinen. The Company Says the New Archival Film, Optimized for Digital Recorders to Preserve Images from Color Digital Masters, Will 'Last Centuries.'

Don't count Kodak out just yet.

The beleaguered film manufacturing company, which filed for Chapter 11 last January, realigned its top management team this summer and continues to roll out 35mm, 16mm and Super 8 color negative, print and digital intermediate film aimed at filmmakers shooting a variety of commercial, music video, television, independent and studio feature work. But Kodak is also focusing heavily on archiving and preservation, recently introducing KODAK Color Asset Protection Film 2332 and calling it an affordable archival color film option for those shooting "television programs, independent features and documentaries." Today, the company added another product to its collection of "asset protection" films, KODAK VISION3 Digital Separation Film 2237.

According to Kodak, the new black-and-white recorder film is intended for making archival separations from color digital masters to preserve images right down to the "fine detail, tight grain, optimal resolution, and excellent flare characteristics" of the original. The archival film is also optimized for the "spectral sensitivity" of the laser, CRT and LED light sources inside the digital recorders pulling those separation images from the color masters.

KODAK VISION3 is built on Kodak's trade-marked polyester ESTAR base, not traditional cellulose acetate, which the company says will give it long-term stability that should "last centuries" under optimal archival conditions. Said Entertainment Imaging Division product manager Diane Carroll-Yacoby in a release, “This film is designed to create archival elements from digital image files that maintain the integrity of the original content with extraordinary precision. The improvements we have introduced into this stock are based on our deep knowledge of image science, film design, digital recorders, and production workflow from our research and development over the past few decades."

Despite its official Chapter 11 status, Kodak continues to quietly prepare for its future by emphasizing a public commitment to R&D, an awareness of evolving post workflows and its uninterrupted, embedded relationship with the television and motion picture industry. Said Carroll-Yacoby, "Kodak scientists continue to push the boundaries of film technology, and uncover ways to optimize the extraordinary characteristics of film for today’s digital post-production workflows.” A Rochester newspaper reported this summer that the company had released an internal memo to employees in July explaining how continued reshuffling of its top brass was an effort to reemerge from bankruptcy by 2013.

Some of the company's new technology development, however, appears to be on hold until a new buyer is found or a final reorganization plan is put into practice. Prior to its bankruptcy filing in January, Kodak had been investing heavily in laser projection technology before licensing about 50 "patent families" to IMAX around this same time last fall. As indicated by the company's laser projection technology division home page, more products are on the way, though exactly what will be released and when is still undefined.
