FCEL International Deployment Programs
South Korea
South Korea adopted a renewable portfolio standard (RPS)1 to promote clean energy, reduce carbon emissions, and develop a local green-industry to accelerate economic growth. The RPS is designed to increase renewable power generation to 10 percent of total power generation by 2022 from two percent in 2012 by requiring an additional one half of one percent of new & renewable power added annually from 2012 to 2016, increasing to one percent per annum through 2022. This equates to an estimated 350 MW annually through 2016, increasing to about 700 MW annually thereafter. Electric utilities and independent power producers that have in excess of 500 MW of power generation capacity are required to comply with the RPS.
Renewable Heat Obligation program creation is in process to accelerate the adoption of combined heat and power (CHP) installations with targeted implementation in 2016.
The South Korean government expects to initiate a cap-and-trade system in 2015, targeting about 60 percent of greenhouse gas emissions from industrial operations that produce more than 25,000 tons of CO2 per year. The South Korean government has pledged to reduce greenhouse gas emissions 30 percent by 2020 from projected levels. The cap-and-trade legislation is designed to link internationally with emissions trading systems in other countries.
Germany
There are a number of financial incentives in Germany for stationary fuel cell power plants operating on either clean natural gas or renewable biogas. Combined heat and power (CHP) configurations receive additional incentives as the German government wants 25 percent of electricity generation to include CHP by 2020, up from the current level of 15 percent. Germany uses a FiT as the foundational incentive program driving adoption of CHP, and the National Organization Hydrogen and Fuel Cell Technology (NOW) program as the lever that provides differentiation for fuel cells against conventional technology.
1An RPS is a mechanism designed to promote the adoption of renewable power generation. The RPS may be voluntary or mandated through legislation and generally places the obligation on the suppliers of electricity to generate a specified percentage of their electricity from renewable power sources. The purpose of an RPS is to provide a program that provides a competitive marketplace for providing renewable energy at the lowest possible cost while allowing clean renewable power to compete with cheaper but ‘dirtier’ fossil fuel power generation. An RPS may even be structured to promote economic growth through adoption of renewable power generation.
Fuel cells can play a role in meeting RPS clean power mandates by generating highly efficient, clean electricity continuously. Fuel cells operating on renewable biogas meet the requirements of typical RPS programs and many RPS programs include fuel cells operating on natural gas due to the near zero emissions and highly efficient power generation process of fuel cells.
PEMFC emerged as the leading product segment in the overall market and accounted for 88.6% of total units shipped and 42.8% of total capacity in 2013. However, MCFC is expected to be the fastest growing product segment for fuel cell at an estimated CAGR of 56.6% from 2014 to 2020.
Portable applications dominated the global application market for fuel cells, accounting for 71.2% of total unit shipments in 2013. However, in terms of capacity, stationary applications emerged as the leading application market and accounted for 58.1% of total capacity installed in 2013.
North America emerged as the leading consumer for fuel cell in terms of installed capacity and accounted for 42.5% of total capacity in 2013. In terms of total unit shipments, Asia Pacific emerged as the leading consumer and accounted for 36.9% of total market in 2013. However, North America is expected to surpass Asia Pacific to become the largest market for fuel cell both in terms of unit shipments and capacity by 2020.
The global market is highly concentrated with top four participants catering to over 70% of global demand. The market is dominated by companies such as Fuel Cell Energy, Ballard, Clearedge and Toshiba. breaking event is scheduled on April 2, 2014 at the Company's Delta,

Falsch, denn in dem Vertrag steht, dass POSCO eine Produktionsstätte in Südkorea unter der Lizenz von FCEL baut und dies durch Milestone- und Royalty-Zahlungen ausgleicht.
Und da steht nichts von "hätte, wäre, würde". Hier Auszüge aus dem Vetrag:
The Cell Technology Transfer and License Agreement provides POSCO Energy the rights to manufacture carbonate fuel cell components in South Korea based on DFC technology and grants commercial rights to Asian markets. The agreement harmonizes two prior license agreements so that POSCO Energy has rights to manufacture the entire carbonate DFC power plant.
A production facility will be built at the POSCO Energy campus in Pohang, South Korea to produce up to 140 megawatts of fuel cell components annually, with equipment initially procured for an expected annual production volume of 70 megawatts. Construction will begin in early 2013 and fuel cell component production is expected to start in late 2014 or early 2015. FuelCell Energy will collaborate with POSCO Energy under the license agreement to provide design and procurement assistance for the facility. POSCO Energy has already invested in fuel cell module assembly capabilities and balance of plant manufacturing at its Pohang campus.
The License Agreement payments total $18 million and the amendment to prior agreements totals $8 million. The initial payment of $10 million was received on November 1, 2012. POSCO Energy will also pay a 3.0 percent royalty to FuelCell Energy for each power plant built and sold by POSCO Energy during the next 15 years.
