Nach der Lehman-Pleite habe ich sogenannte Escrows in meinem Depot.

Was kann ich damit tun?

Muss ich von meiner Seite aus etwas unternehmen?

 

Sorry wenn das schon vorher in einem der Threads diskutiert wurde, ich habe nur auf die Schnelle nichts gefunden.

Im Web gibt es einige Seiten in denen Dinge auf höchst juristischem Englisch erklärt werden. Der Sinn hat sich mir aber nicht erschlossen.

Eine Erklärung für den Durchschnittsbürger wäre höchst willkommen!

 

 Du musst nichts unternehmen, und Du kannst nichts mit den "escrows" tun. Aufgrund des bestehenden Defizits in mehrstelliger Milliardenhöhe sind diese Escrows wertlos, und werden, wenn auch wohl erst nach mehreren Jahren, ausgebucht werden. Es liegt ein Totalverlust vor.

 

... ist vollkommen richtig. - Der Rest allerdings ist reine Speculation.

Pfandbrief: Die Aussage Deinerseits ist mir leider schon wieder zu sicher prognostiziert.
Du hast damals auch gesagt, dass es für die alten Wamus nichts mehr gibt und es gab bislang schon neue Aktien, zusätzlich zu den Escrows, wenn man Releases erteilt hat.

Könnte man in Dein Posting oben nicht wenigstens das Wort "wahrscheinlich" einfügen ?
Damit hättest Du Dich nicht zu 100% festgelegt, in diesem Fall der ja noch offen ist.
Wunder gibt es immer wieder :-)
Und ich lese von Teras immer und immer wieder "Subpoena ISSUED".
Soweit ich mich da als Nicht-Jurist erinnere, ist das eher was gutes für uns Escrow-Halter ?

Deswegen wärs doch besser zu schreiben .. " unter den momentanen Bedingungen und wenn ... dann .... " oder ?

Wenn die Menschen in ihrem Sprachgebrauch mehr "vielleicht" und "wahrscheinlich" verwenden würden, dann wäre die Welt vielleicht eine bessere Welt. Meine Meinung.

Hätte man bei Wamu nicht auch so auf Escrows bestehen können, ohne dass man Releases erteilen hätte müssen ? Beispielsweise dass man dann eben nur Escrows bekommen hätte und keine neuen WMIs. Irgendwie habe ich den Unterschied noch nicht 100% verstehen, neben der Tatsache, dass es bei Lehman eben kein EC gibt. Geklagt wird doch in beiden Fällen ?

Weil der POR bei Wamu das halt verlangt hat. Und der POR hat es verlangt, weil die Parteien, die Beiträge zum GSA geleistet haben (insbesondere JPM und der FDIC receiver) darauf bestanden haben. Ansonsten hätte es das GSA in dieser Form nicht gegeben, und die Quote für die Gläubiger wäre bei Wamu wohl ähnlich ausgefallen wie die bei Lehman, und die Aktionäre wären bei Wamu nicht mal in die Nähe einer recovery gekommen, wie es halt bei Lehman ist. 

Bei Lehman gab es nichts vergleichbares; es ist auch ganz irrelevant, weil die escrows lediglich theoretisch existieren. 

Was das "wahrscheinlich" betrifft, Du vergisst dass hier bereits die Sache gegessen ist. Bei Wamu war sie es (damals) noch nicht. 

 

....also bei mir sind die escrows nicht nur theoretisch im Depot sondern ganz Real ;-)

wieviele offenen oder falsche Docket gibt es eigentlich noch.
@Teras , willst Du jetzt bis in das Jahr 2018 alle ungerechtfertigten Forderungen hier einstellen?  

... also die LEHMAN-seitigen EINSPRÜCHE gegen Forderungen und "Forderungen", zudem auch die richterlichen Claim(s)-REJECTIONS (Forderungs-ABWEISUNGEN),
und natürlich die Claim(s)-WITHDRAWALS (Forderungs-ZURÜCKZIEHUNGEN)...

Also ganz genau so, wie ich es vor nunmehr über 3 Jahren verbindlich übernommen habe. Die Serie derer Subpoenas ISSUED hingegen, deren Documentierung ich ja nie zugesagt hatte, werde ich demnächst ausklingen lassen, da es sonst zuviel Arbeit ist.
