Lehman brokerage trustee strikes settlement with finance unit

"Oct 4 (Reuters) - The trustee liquidating Lehman Brothers' U.S. brokerage has reached a settlement with its former derivatives unit that will reduce to $550 MILLION an original claim of $6 BILLION, according to court documents.

The deal will enhance the ability of the trustee, James Giddens, to distribute payouts to former clients of Lehman Brothers' brokerage four years after the investment bank collapsed.

Lehman Brothers Finance AG, which was based in Switzerland, will receive a $190 million customer claim and a $360 million general unsecured claim against the brokerage, according to a document filed Wednesday in Manhattan's bankruptcy court.

Customer claims are paid before general unsecured claims.

The finance unit specialized in structuring derivatives transactions. The liquidator of the finance unit, Pricewaterhouse-Coopers AG, had claimed that about $6 billion in securities and cash were held in accounts at Lehman Brothers brokerage. The finance unit's claims were among the largest submitted against the brokerage, according to the court filing by Giddens"...

Lehman brokerage, Europe unit settle $38 billion in claims

(Reuters) - The U.S. brokerage unit and a European unit of the former Lehman Brothers Holdings Inc said they settled a dispute over $38 billion in asset claims, a major step toward customers and creditors recovering money.

Lehman Brothers Inc and Lehman Brothers International Europe (LBIE), its largest single customer claimant, announced the agreement in principle in a joint statement on Friday.

The accord requires approval by U.S. Bankruptcy Judge James Peck in Manhattan, which could come in the first quarter of 2013, as well as by the English High Court.

On Thursday, the U.S. brokerage unit announced a separate agreement with its former Swiss-based derivatives unit Lehman Brothers Finance AG.

Taken together, the agreements resolve two of the biggest outstanding claims facing the U.S. brokerage unit.

James Giddens, the trustee liquidating Lehman's brokerage unit, called Friday's accord a "critical milestone" that would let customers recover 100 percent of their property much sooner than if LBIE litigated claims over more than 200,000 trades.

Tony Lomas, joint administrator of LBIE, said under the accord he can focus on how to distribute more than $7 billion in assets.

Under the agreement, the European unit will be allowed $8 billion in claims for customer accounts. The accounts include $7.5 billion in securities and cash and $500 million in cash net equity.

The unit will also be entitled to a $4 billion general property claim, plus $600 million of "post-filing income."

Lehman Brothers Inc's $13.8 billion unsecured claim against the European unit will be eliminated. They will suspend litigation through mid-December while they craft a final accord.

Peck allegedly told police that the blowup began over his wife’s late arrival at the house from the Hamptons, where she’d been earlier in the week.

Peck said his wife slapped him first, as he was taking a ladder out of his closet.

“She slapped me,” the judge told police, according to the sources. “I put the ladder down. I slapped her. Then we started slapping each other back and forth.”

Remorse apparently set in quickly for Peck, when he told cops, “I will never do it again. We need to go to counseling.”
