hmmm, hc kenn ich nicht und infineon ist vermutlich noch gar nicht auf dem radar.
die patent mappe ist gültig, das ist längst bekannt, siehe re-examinations uspto.
ob die industrie die patente verletzt, nun das ist in der mache, einerseits ndoc case gegen acer, htc, hier sind wird beklagte und gegenkläger, anderseits itc, hier haben wir geklagt auf verletzung und auf verbot des verkaufes der produkte der 12 firmen, u.a. amazon, samsung, barnes, acer, htc, usw.
hier beginnt der trial, die verhandlung vor gericht anfang juni 2013.
allerdings haben wir seitens der gerichte weder vom markman in dez 2012 (ndoc) noch vom märz 2013 (itc) bisher etwas offizielles gehört.
wenn die produkte der firmen die patente verletzen, ja, dann hören wir definitiv noch etwas in diesem jahrzehnt. vermutlich früher also bereits in 3-6 monaten.
Gegen 12 Firmen, u.a. Amazon, Samsung, Barnes, Acer, Htc ect. ja da sollte doch endlich
mal was gescheites gehen. Verkaufsverbote einklagen ist ja gut, aber das machen andere
Patentinhaber - eben wo das Patent bestätigt ist - dann im Eilverfahren in Form dass
eine dringenst zu erlassende vorsorgliche Verfügung zu erlassen sei, das macht denn
Patentverletzern immer sehr schnell Beine, gut bis sehr zu bezahlen. Begründung;
Weil der Verdienstausfall bei Verkaufsstopp ein vielfaches ausmachen würde.
Da gibt es auch Präjudizfälle genug. PTSC hat doch gute Annwälte, oder nicht ?
Dann sind wir als wieder vertröstet auf September 2012.

die patente sind gültig und sogar mehrfach bestätigt, seitens der uspto, der us patentbehörde.
was noch nicht bestätigt ist durch einen zuende geführten trial ist, verletzen denn die produkte von htc, acer, samsung etc. die patente, DIESER beweis wird nun geführt bei der itc mit dem ziel verkausstop. nachfolgend dann ndoc acer, htc um den schaden materiell zu bemessen.
wenn itc gewonnen ist, dann hat dein szenario gültigkeit, wenn dann ndoc gewonnen ist, dann gibt es auch dazu noch klarheit zu den summen.

na hoffentlich heben wir uns diesen Brocken für eine Lizenz mit xxx mill usd auf, also nach einem Gerichtsurteil das besagt, das alles was nach Fish & Moore gebaut ist, das MMP verletzt!
allerdings ist ja auch qcom genau wie apple quasi Nachbar! da beschleicht mich allerdings schon wieder das Nachbarschafts Deal - Ami - Industrie Rabatt Gefühl

Here are my notes from the ASM:
Not more than 30 -35 people were in attendance. All 4 motions passed and the general meeting adjourned after about 20 minutes. Jim Otteson and Vincent from Agility Law were there and Jim spoke and answered questions mostly surrounding our current ITC litigation. below are some of the salient points:
· Agility is taking the case on contingency and would not be doing so if he did not feel very confident about the MMP
· Jim Otteson said that we emerged from the USPTO stronger than when we went in
· the 336 is Jim's favorite patent in the portfolio & our most valuable asset
· by Jim's account, we won 9 of the 10 claims
· we should here within the next 2 weeks if the Motion for summary determination will be struck down
· the case is slated to be heard before the ITC on June 3rd in D.C.
· We will see the results on the first week in September with final order to be enforced 1/6/14
· The Stay in the NDOC for September 23 should be lifted within a couple weeks
· we are not touting any Markman victories in order not to upset the litigation process
· Agility has 16 or so attorneys or 90% of his firm working the MMP
· According to Dan Leckrone the opposition had 55 attorney's at the last court hearing who represent the most prestigious IP law firms in the world
· there should be no issue proving "domestic industry" in the case
· Jim mentioned that Judge Grewal was formerly a patent litigator in Silicon Valley
Dan Leckrone went on to say that is important to understand the magnitude & effort Agility brings to the prosecution of the MMP portfolio as well as their experience. My take away was that we are in good well-seasoned hands and Agility is the best in the business. All told, the meeting was generally positive and once we overcome the Motion for summary determination we have a strong chance in obtaining an exclusion order for importation of infringing products. Once we achieve this, it gives us much more leverage in negotiations with alleged infringer. Still optimistic kw

I have been a shareholder since 1994, this is the second time I attended the SHM.
Although I spoke with Cliff Flowers a few months ago, and meeting him yesterday confirmed that he is a conservative individual, who measures his words, as well as his actions. IMHO he is great for the task he has a head of him.
Speaking with Gloria, PTSC has great plans for the future but of course there is only so much she can say and stay within the law.
Did not get a chance to meet with Carl Johnson, seem like a nice person.
I had a chance to speak with Dan Leckrone, you can tell that he "commands authority" and carries a "big stick".
I had a question concerning the future of the MMP after the life of the patent ends and much to my dismay he was brutally honest, “assuming we win not much”, he implied WIN is going to be huge, but that there would be other major opportunities for PTSC continuance into the future.
Me.... being an optimist, was kind of dismayed, while many here on many times warned of the same outcome that Dan L. stated, I had always hoped that there would be some way to revive the patents, extend the life of the patents and that is clearly not going to happen after speaking with Dan and Cliff.
However Dan mentioned that there are BIG things coming our way, more opportunities for shareholder value that are in the works that will cause PTSC to continue prospering into the future, while this may give
Dan gave me the impression that he is completely at ease with the PTSC TPL relationship, there seems to be a strong unity between both, imho like mindedness is good for all companies, that there be no division, or strife.
My speculation: Possible Merger in the future? Possible acquisition of more patent portfolios? Continuous of enforcing bullet proof patents? Divies to come?
But for long term sustainability, we need a solid long term Business Plan otherwise many will bail out and never return.
I know many may hate this since it did not work well in the past: More acquisitions of companies? An old saying: If at first you do not succeed, try…try again. The idea is a good one but I think the BOD has learned many costly lessons that they will not repeat again.
Who knows for sure, but after the expected win, I think that the PTSC BOD needs to present a 5 Year business plan outlining how they will increase shareholder value, how the company is expected to grow after the patents expire.
I suppose with Billions in the Bank (I hope) they will be able then do what they could not do before being tied up in litigation.
IMHO with the Proper Court Wins: With the news media informing the world how a tiny company was able to defeat the World’s Best Patent Defense Attorney firms and win big, how a tiny company was kept from success due to patent theft as well as suppressed due to the constant patent reexamination requests made by the infringers, is going to make a BIG Well Known Name for PTSC worldwide and for a business Brand Name Recognition is a must, I trust we will have that.
My Hopes: That the world’s investors want to buy in creating an upsurge in demand for the stock and the stock can only go up, that is if all goes well with the News Media
