美國對Amazon三星等13家公司進行專利調查

【賽迪網訊】8月23日消息，據國外媒體報導，美國國際貿易委員會(ITC)周二表示，它已經手對13家技術公司及其分公司涉嫌侵犯專利的無線消費電子設備及組件進行調查。
三家位於加州的公司此前曾向國際貿易委員會投訴，宣稱這些公司涉嫌侵犯了美國5,809,336 號“具變速系統時鐘之高效能微理器(High performance microprocessor having variable speed system clock)”專利中的權利要求項。該專利被指派給其中一家原告公司Patriot Scientific，它在其官網上將自身定義為一家智慧財產權許可公司。
其中接受ITC調查的公司有宏碁、三星、任天堂、Amazon.com、圖書零售商巴諾公司(Barnes &Noble)、Garmin、HTC、華為、中興、電子品製造商京瓷(Kyocera)以及LG等多家公司。
ITC表示，對這些公司涉及調查的品基本都為帶有無線功能的電子設備。比例平板、智能手機、電子書讀器、移動熱點、寬頻無線調製解調器以及掌上遊戲機。委員會正在考慮原告 :laugh: Technology Properties、Patriot Scientific以及Phoenix Digital Solutions :laugh: 提出對這些品頒佈驅逐令以及暫停及停止銷售令的建議。
外界預計ITC將在調查開始的45天內設定一個完成調查的終止日期。ITC對是否違反337項條款的調查經常都涉及到智慧財產權。其中包括專利侵犯指控以及進口貨物的商標侵權。
Patriot Scientific表示，早在7月份，公司因這13家公司未支付特許專利使用費及未付應付利息，向加州地方法院投起訴了這些公司，並要求其進行賠償。

Gemeinsam mit ihrem langjährigen Partner Technology Properties Limited (TPL) hat die US-Firma Patriot Scientific vor der Internationalen Handelskommission (ITC) der USA und einem Bundesgericht Klage gegen 13 IT-Unternehmen erhoben. Die Verfahren richten sich gegen den Rechnerhersteller Acer, die Tablet-Anbieter Amazon und Barnes & Noble, die Smartphone-Produzenten HTC, Huawei, LG, Samsung und ZTE sowie Garmin, Kyocera, Nintendo, Novatel Wireless und Sierra Wireless. Sie sollen Patente aus dem sogenannten "Moore Microprocessor Patent"-Portfolio (MMP) verletzt haben. Diese gehören ursprünglich dem Erfinder der Programmiersprache Forth, Charles H. Moore.
Anlass für die jetzige Groß-Klage könnte eine Entscheidung des US-Patentamts sein: Es bestätigte nach jahrelanger Prüfung Anfang 2012 unter anderem das 1998 erteilte MMP-Patent 5,809,336. Es beschreibt ein CPU-Design, bei dem der Prozessor einen schnelleren Taktgeber benutzt als die I/O-Schnittstellen.
Diesem Patent kommt zudem eine besondere Bedeutung zu, da es als einziges noch über eine nennenswerte Restlaufzeit verfügt: Es erlischt erst 2015. Die beiden anderen Patente 5,440,749 und 5,530,890, die ebenfalls Details von Mikroprozessoren beschreiben, stammen aus den Jahren 1995 und 1996. Ersteres ist am 8. August dieses Jahres ausgelaufen. Deshalb können die Kläger keine Unterlassung mehr verlangen, aber noch Schadenersatz für die vergangenen sechs Jahre fordern. (ck)

USITC INSTITUTES SECTION 337 INVESTIGATION ON CERTAIN WIRELESS CONSUMER ELECTRONICS DEVICES AND COMPONENTS THEREOF
The U.S. International Trade Commission (USITC) has voted to institute an investigation of certain wireless consumer electronics devices and components thereof. The products at issue in this investigation are consumer electronic devices with wireless capabilities, such as electronic tablets, smartphones, e-readers, mobile hotspots, broadband wireless modems, and handheld game consoles.
The investigation is based on a complaint filed by Technology Properties Limited LLC and Phoenix Digital Solutions LLC of Cupertino, CA, and Patriot Scientific Corporation of Carlsbad, CA, on July 24, 2012. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain wireless consumer electronics devices and components thereof that infringe a patent asserted by the complainants. The complainants request that the USITC issue an exclusion order and cease and desist orders.
The USITC has identified the following as respondents in this investigation:

By instituting this investigation (337-TA-853), the USITC has not yet made any decision on the merits of the case. The USITC's Chief Administrative Law Judge will assign the case to one of the USITC's six administrative law judges (ALJ), who will schedule and hold an evidentiary hearing. The ALJ will make an initial determination as to whether there is a violation of section 337; that initial determination is subject to review by the Commission.
The USITC will make a final determination in the investigation at the earliest practicable time. Within 45 days after institution of the investigation, the USITC will set a target date for completing the investigation. USITC remedial orders in section 337 cases are effective when issued and become final 60 days after issuance unless disapproved for policy reasons by the U.S. Trade Representative within that 60-day period.

(a) guter Grund zum Kauf besteht (Erfolge im Hintergrund?, Vertrauen in die weitere Entwicklung? Erwartung steigender (ergo schlechterer Rückkauf-)Kurse?) und
(b) Liquidität hierfür vorhanden ist (jüngste Einnahmen?)
Beides wäre natürlich klasse. Ich bin gespannt, ob die Zahlen erste Hinweise in diese Richtung geben werden.
Bleibt allerdings noch immer die Frage, wer denn nun der VERKÄUFER in diesem ganz offensichtlich fein durchorganisierten Spiel ist...

AMD deal boosts Patriot Scientific stock

Patriot Scientific Corp.'s stock rose 78 percent yesterday, after the company announced that chip-maker AMD had purchased restricted shares in the San Diego company and had licensed some of its microprocessor technology.

Shares of Patriot Scientific, which is traded on the over-the-counter bulletin board, closed at 25 cents, up from 14 cents.
The terms of the deal are confidential, said Lowell Giffhorn, Patriot Scientific's chief financial officer.

Die haben sicher einen größeren Posten übernommen und haben als "Großaktionär" etwas mehr Einblick als wir Wurstel.
Möglicherweise versucht jemand die letzten Tage ein Stück vom großen Kuchen abzuschneiden.Das 500 000 Stück Pakete gekauft und nicht verkauft wurden sieht man an den Teilausführungen.Es muss also zwingend Interesse bestehen.
Könnten wir nicht den Richter mal kurz ausleihen?
- nicht nur wegen der Höhe der Strafe - sondern auch der Dauer ( 6 Jahre ist eine lange harte Zeit für jeden "Longi")!
