Ihr wisst ja, ich bin bei dieser PR-Flut skeptisch, muss aber zugeben, dass die Maschinerie läuft. Wenn das alles kein Fake ist, werden wir im nächsten Jahr noch viel Spaß haben... ;-)

p.s. Derweil zerbreche ich mir den Kopf darüber, warum die Richterin so lange braucht, um die "Motion to Dismiss" abzusegnen. Weiterhin KEINE NEWS auf Pacer...

stay, abat sendet eindeutige zeichen, dass das operative geschäft während der " dark period" nicht gelitten hat, ganz im gegenteil, abat scheint besser aufgestellt als noch in 2011. dies kann allerdings nur untermauert werden mit der veröffentlichung von unabhängig geprüften finanzberichten...

warum ist die derivative suit noch nicht abgeschlossen?
2 vermutungen:
1. das gericht wartet mit einer entscheidung bis zur veröffentlichung von finanzberichten. erst wenn abat sich ans us-security-law hält, bekommt abat "grünes licht"...
2. das gericht schaut bei braun/blumka genauer hin... denn was hier passiert ist, ist unglaublich und lässt vermuten, dass die derivative suit ein werkzeug der shortseller (VVR) war...

1. Das wäre mein Wunsch, glaube aber nicht, dass sich das realisieren ließe, denn wenn die Klage unzulässig war, hätte sie auch kein Druckmittel.
2. Möglich, aber ich gehe davon aus, dass sie dann ja ohnehin die Staatsanwaltschaft einschalten müsste, welche wiederum eine separate Klage erheben würde.
Die für mich "logischste" Möglichkeit ist das "Bezahlproblem", welches natürlich eng mit Deiner Möglichkeit "2" verbunden ist: Warum sollte ABAT für die Anwalts- und Gerichtskosten aufkommen müssen, wenn die Klage von einer Person initiiert worden ist, die zum Zeitpunkt der Erhebung gar kein Aktionär mehr war und somit keinerlei Verbindung zu ABAT hatte? Kniffelige Frage, denn so ganz billig dürfte das alles nicht werden...
p.s. Ich denke auch, die Richterin hatte Lunte gerochen. Denn sie war es, die im Hearing explizit darauf bestanden hatte, von Braun Nachweise über dessen Aktien-Besitz zu bekommen... ;-)

...sie wollen wohl ihre produktion für neue produkte umkrempeln? keine ahnung ob dies positiv oder negativ zu bewerten ist. grundsätzlich spricht ja gegen eine modernisierung nichts, doch wenn die produktion für ein halbes jahr beeinträchtigt wird?

naja, zumindest geht es heute aufwärt.

1. es gibt gerüchte, die buchhalter hätten noch nicht mit ihrer arbeit begonnen.....

( womöglich sind die gerüchte haltlos. hab die buchhalter kontaktiert, die antwort:
"Sorry to be unresponsive, but professional standards prohibit auditors from releasing information, other than that included in the audited financial statement. Please contact the company directly." )
.... sollten es dennoch stimmen, dass die buchhalter ihre arbeit nicht begonnen haben, dann wird es womöglich unwahrscheinlich, dass ABAT die finanzberichte im ersten quartal veröffentlichen wird....
...daraus resultiert die möglichkeit, dass aktionäre versuchen über ein "receivership" kontrolle über die vermögenswerte von ABAT zu erhalten....

2.  die wahrscheinlichkeit wird immer grösser, dass die SEC einschreitet und ABAT aus dem handel nimmt, da ABAT nun seit jahren gegen das us-security law verstösst...

3. ein hedgefund hat 1,5mio aktien erworben und klage gegen ABAT (court of delaware / case (C.A. No. 9542-ML ) erhoben. wahrscheinlich ist man auf put-optionen aus, was ABAT teuer zu stehen kommen könnte....

4. dongguan wird aufgrund neuer produkte umgerüstet. angeblich steht dafür die produktion ein halbes jahr still. allerdings gibt es dazu nur ein "bulletin" auf der abat-webseite.... die übersetzung ist ziemlich schlecht, man muss diese 2x mal lesen, um etwas zu verstehen.... (siehe posting von shaki)

5. auf anfragen reagiert ABAT nicht....

.... natürlich, kann weiterhin alles gut ausgehen... ABAT muss nur schnellstmöglich die finanzberichte veröffentlichen! jeder muss für sich selbst entscheiden, wie gross die eigene risikotoleranz ist....

Na ja, wie ihr wisst, bin ich ob der ABAT-PR's nach wie vor sehr skeptisch. Über Google ist nichts über die Firma "Jiangsu Duke New Energy" zu finden. Chinesisch kann ich leider nicht. Dürfte aber die heutigen Umsätze hinreichend erklären... ;-)

hi stay, ich hatte kontakt mit einem ex-vertriebspartner von abat/wuxi. leider hab ich genau gegenteiliges erfahren, was mir von seiten abat's mitgeteilt wurde.
hat schonmal jemand versucht mit vertriebspartnern von abat/wuxi in europa kontakt aufzunehmen?
keine ahnung was hier läuft, aber
abat hat mein vertrauen verspielt.... lass mich hier gern überraschen, aber
von den versprochen finanzberichten noch keine spur. dann noch die geschichte mit southpaw....

Danke für die Info. Ich muss Dir ehrlich sagen, dass ich mich nicht so furchtbar viel um ABAT kümmere. Wollte gestern nur für mich persönlich eine Erklärung für den Volumen- und Preisanstieg haben. Ich habe mit ABAT im letzten Jahr ganz gut verdient und lasse den Rest laufen. Vertrauen haben ich zu der Bude keines, was ich ja auch schon mehrmals zum Ausdruck gebracht habe. Sollten natürlich tatsächlich einmal die Jahresabschlüsse nachgereicht werden, wäre ich nicht abgeneigt, noch einmal Kasse zu machen... ;-)

N'abend,
habe mich heute einmal wieder mit ABAT beschäftigt. Wie Thomas schon bemerkt hatte, ist der ABAT-Handel hierzulande mittlerweile nur noch in Stuttgart möglich, Berlin und München haben den Handel eingestellt. Als Grund nennt die Börse Berlin "Illiquidität", d.h. für mich, es gibt schlichtweg keinen Umsatz mit dieser Aktie.

In Stuttgart war der deutsche Handel ja immer am stärksten, aber es steht natürlich in den Sternen, ob die Aktie dort auch zukünftig gehandelt werden wird. Im Yahoo-Board werden die üblichen Verdächtigen nicht müde, immer wieder zu erwähnen, dass die SEC die Aktie wegen der fehlenden Jahresabschlüsse seit 2011 ebenfalls delisten könnte. Die Gefahr einer - zumindest temporären - Handelsaussetzung wird m.E. tatsächlich immer größer, denn die SEC fährt ja ohnehin seit dem letzten Jahr eine härtere Schiene bei den Penny Stocks. Jeder sollte sich also des Risikos bewusst sein. Falls jemand bei einem Broker ist, bei dem er ABAT nicht in den USA handeln kann, ist das Risiko natürlich noch größer, denn wie man sieht, müssen die deutschen Börsen nicht auf die SEC warten, sondern können selbst handeln. Auch das sollte man berücksichtigen.

Überdies - und jetzt kommt das Spannende/Interessante/Traurige (kommt auf die Sichtweise an) - hat sich vor Gericht einiges getan: Wie ich schon vor Monaten hier und auf Yahoo vermutet hatte, wurde der "Motion to Dismiss" der ABAT-Anwälte statt gegeben, wodurch die Derivative Action (für ABAT) vom Tisch ist. Wie ich ebenfalls vermutet hatte (schöne Grüße an die Ami-"Schlauberger" auf Yahoo...), sitzt nun plötzlich Mr. Braun nebst Anwälten auf dem Anklagestuhl, denn Richterin McMahon war sichtlich sauer, von diesen salopp gesagt nach Strich und Faden belogen worden zu sein. Sie hat die Geschichte an eine andere Richterin abgegeben, die Braun und dessen Rechtsverdreher zu einem Hearing hereinbestellt hatte, in dem diese beiden Gründe dafür vortragen sollten, warum man (die Richterin) sie nicht sanktionieren sollte. Dürfte denen schwergefallen sein. Kosten der ABAT-Anwälte sollen die auch übernehmen, wobei McMahon an denen auch kein gutes Haar gelassen hat. Daraufhin gab es von den ABAT-Counsels erst einmal eine detaillierte Kostenrechnung mit Auflistung der Arbeiten... ;-) Kaplan hat sich ebenfalls wieder eingeschalten: Die Richterin sollte ihm einen Anwalt "bezahlen" damit er den Fall weiter verfolgen könne. Sie sagte aber - ich übersetze es jetzt einmal auf hochdeutsch - dass sie nicht das Sozialamt für Leute spielen kann, die selbst nicht gerade verarmt sind und nur nicht die Absicht haben, weiter ihr eigenes Geld zu "verbrennen".

Daraufhin hat sich Kaplan an die neue Richterin gewendet und kam dabei mit einer durchaus interessanten Sache um die Ecke: Die Richterin solle doch bitteschön einmal das Motiv von Braun "entschlüsseln" und klären, ob er nicht (als Strohmann) von den Short Sellern "vorgeschickt" worden wäre. Könnte also noch höchst unangenehm und teuer für Braun werden.

Leider sind die "Minute Entries" nicht einzeln aufgeführt, weshalb ich nicht sagen kann, ob neben der ABAT-Anwältin (die nun von Braun die Kohle haben will) auch Braun nebst Anwälten vorstellig wurde. Es bleibt deshalb weiterhin spannend...! ;-)

p.s. Die Richterin hat in der Antwort auf Kaplans Brief mit ihrer Meinung über ABAT nicht hinterm Berg gehalten: Sie lässt kein gutes Haar an der Bande. Sie sagt auch klipp und klar, dass sie die Akten nicht geschlossen hätte, wenn Braun seine Aktien vorher nicht schon verkauft hätte, wodurch er gar nicht hätte klagen dürfen. Sie nennt das alles "sehr suspekt". Ich will hier niemanden verunsichern, aber das klingt alles nicht gut. Auf die Jahresberichte wartet man ja auch (noch?) vergebens. Im nächsten Posting stelle ich mal eine Übersicht der Pacer-Doks des laufenden Jahres nebst Anmerkungen der Richterin ein. Dann kann sich jeder selbst ein Bild darüber machen und für sich selbst urteilen, ob er investiert bleiben möchte oder nicht. Die Entscheidung kann einem niemand abnehmen... ;-)

p.s. Ist absolut lesenswert. Der ABAT-Anwalt hat übrigens im Verlauf des Prozesses das Handtuch geworfen wegen Problemen bei der Begleichung seiner Rechnungen. Ich denke, das sollte jedem ABAT-Aktionär zu denken geben...

ich bezweifle derzeit stark, dass abat noch irgendwelche finanzberichte veröffentlichen wird. für mich wäre dies eine echte überraschung!

wie sich an der derivative suit zeigt, kämpften vermutlich die shortseller mit allen mitteln, um den kurs zu drücken.

abgesehen von den zweifelhaften methoden der shortseller,  vermute ich derzeit ebenfalls, dass abat tatsächlich bei umsatz und gewinn log.
weiterhin vermute ich auch, dass abat sich in einer finanziellen notlage befinden, nachdem der geldhahn vom kapitalmarkt abgedreht wurde.
dongguan produziert nicht mehr. wuxi, laut ex-vertriebspartner, auch nicht mehr.

es ist nur noch eine frage der zeit, bis die sec einschreitet.
ohne finanzberichte gibt es derzeit kein grund hier investiert zu sein. (m.m.)

ps: selbst southpaw hat es nicht geschafft, in die bücher einsicht zu bekommen, die begründungen von abat, warum dies nicht ginge, sind lächerlich.
warum sollte paritz alle unterlagen  bekommen, um mit ihrer arbeit anzufangen?

Na ja, sie haben immerhin das "Angebot", nach China zu fliegen und sich die Sachen anzuschauen, lol... ;-)

p.s. Sehr interessant finde ich, dass auf dem Yahoo Board mein Beitrag mit den Links zum "Southpaw-Urteil" kommentarlos gelöscht wurde. Deshalb hier noch einmal auf deutsch mein kleiner Hinweis: Schaut euch mal an, wann Southpaw die Shares erworben hat. Da ist mir schon klar, dass die jetzt irgendwie versuchen wollen, wieder an ihre Kohle heranzukommen... ;-)

du bist ein richtiger recherchier-held :-).

hm, weiß auch nicht was ich tun soll. kann mir aber nicht vorstellen, dass der anwalt nur geschmissen hat wegen geldforderungen an abat. wär dies so, würden die lichter bald ausgehen. so was könnte ich mir bei einer briefkastenfirma vorstellen. abat ist aber im batterieproduzierendem gewerbe tätig. klar, sowas geht auch pleite, doch will wohl einfach nicht wahrhaben dass sie vorm konkurs sind. sie produzieren und verkaufen ja weiterhin. hoffe es kommt neuer finanzbericht, in dem von mir aus auch ersichtlich wird, dass es unregelmäßigkeiten gegeben hat, aber dann ist tabula rasa.

After an investigation, the Division of Enforcement alleges that:
A. RESPONDENTS
1. Advanced Battery Technologies, Inc. (CIK No. 745651) is a delinquent
Delaware corporation located in Shuangcheng, China with a class of securities registered
with the Commission pursuant to Exchange Act Section 12(g). Advanced Battery
Technologies is delinquent in its periodic filings with the Commission, having not filed
any periodic reports since it filed a Form 10-Q for June 30, 2011. As of September 8,
2015, the company’s stock (symbol “ABAT”) was quoted on OTC Link (previously,
“Pink Sheets”) operated by OTC Markets Group, Inc. (“OTC Link”).
2. Chauvin Enterprises, Inc. (a/k/a Internet Solutions for Business, Inc., a/k/a
International Solutions for Business, Inc.) (CIK No. 1097394) is a merged Delaware
corporation located in New York, New York with a class of securities registered with the
Commission pursuant to Exchange Act Section 12(g). Chauvin Enterprises is delinquent
in its periodic filings with the Commission, having not filed any periodic reports since it
filed a Form 10-QSB on January 31, 2000.
3. Oilsands Quest Inc. (CIK No. 1096791) is a Colorado corporation located in
Calgary, Alberta, Canada with a class of securities registered with the Commission
pursuant to Exchange Act Section 12(g). Oilsands Quest is delinquent in its periodic
filings with the Commission, having not filed any periodic reports since it filed a Form
10-Q on January 31, 2012, which reported a net loss of $733,669,000 from the
company’s April 3, 1998 inception through January 31, 2012.
B. DELINQUENT PERIODIC FILINGS
4. As discussed in more detail above, all of the Respondents are delinquent in
their periodic filings with the Commission, have repeatedly failed to meet their
obligations to file timely periodic reports, and failed to heed delinquency letters sent to
them by the Division of Corporation Finance requesting compliance with their periodic
filing obligations or, through their failure to maintain a valid address on file with the
Commission as required by Commission rules, did not receive such letters.
5. Exchange Act Section 13(a) and the rules promulgated thereunder require
issuers of securities registered pursuant to Exchange Act Section 12 to file with the
Commission current and accurate information in periodic reports, even if the registration
is voluntary under Section 12(g). Specifically, Rule 13a-1 requires issuers to file annual
reports, and Rule 13a-13 requires domestic issuers to file quarterly reports.
6. As a result of the foregoing, Respondents failed to comply with Exchange Act
Section 13(a) and Rules 13a-1 and/or 13a-13 thereunder.

III.
In view of the allegations made by the Division of Enforcement, the Commission
deems it necessary and appropriate for the protection of investors that public
administrative proceedings be instituted to determine:
A. Whether the allegations contained in Section II hereof are true and, in
connection therewith, to afford the Respondents an opportunity to establish any defenses
to such allegations; and,
B. Whether it is necessary and appropriate for the protection of investors to
suspend for a period not exceeding twelve months, or revoke the registration of each
class of securities registered pursuant to Section 12 of the Exchange Act of the
Respondents identified in Section II hereof, and any successor under Exchange Act Rules
12b-2 or 12g-3, and any new corporate names of any Respondents.

IV.
IT IS HEREBY ORDERED that a public hearing for the purpose of taking
evidence on the questions set forth in Section III hereof shall be convened at a time and
place to be fixed, and before an Administrative Law Judge to be designated by further
order as provided by Rule 110 of the Commission’s Rules of Practice [17 C.F.R.           §
201.110].
IT IS HEREBY FURTHER ORDERED that Respondents shall file an Answer to
the allegations contained in this Order within ten (10) days after service of this Order, as
provided by Rule 220(b) of the Commission’s Rules of Practice [17 C.F.R. § 201.220(b)].
If Respondents fail to file the directed Answers, or fail to appear at a hearing after
being duly notified, the Respondents, and any successor under Exchange Act Rules 12b-2
or 12g-3, and any new corporate names of any Respondents, may be deemed in default
and the proceedings may be determined against them upon consideration of this Order,
the allegations of which may be deemed to be true as provided by Rules 155(a), 220(f),
221(f), and 310 of the Commission’s Rules of Practice [17 C.F.R. §§ 201.155(a),
201.220(f), 201.221(f), and 201.310].
This Order shall be served forthwith upon Respondents personally or by certified,
registered, or Express Mail, or by other means permitted by the Commission’s Rules of
Practice.
IT IS FURTHER ORDERED that the Administrative Law Judge shall issue an
initial decision no later than 120 days from the date of service of this Order, pursuant to
Rule 360(a)(2) of the Commission’s Rules of Practice [17 C.F.R. § 201.360(a)(2)].
In the absence of an appropriate waiver, no officer or employee of the
Commission engaged in the performance of investigative or prosecuting functions in this
or any factually related proceeding will be permitted to participate or advise in the
decision of this matter, except as witness or counsel in proceedings held pursuant to
notice. Since this proceeding is not “rule making” within the meaning of Section 551 of
the Administrative Procedure Act, it is not deemed subject to the provisions of Section
553 delaying the effective date of any final Commission action.

laie, die SEC hat das licht hier ausgemacht! aber zhiguo fu hat den laden schon weit vorher gegen wand gefahren. dongguan und wuxi sind ziemlich sicher pleite...harbin?.
würde mich nicht wundern, wenn bereits alle assets verramscht wurden.... mehr zu ABAT ist im geschichtsbuch zu finden, unter c wie chiscam!
