Yeah, a gap up, and perhaps even more than you suspect (but it's good to be conservative). I only say this because of the German exchange and their move up of about 5-8 cents (after conversion). What I'm thinking is that only a very few of the German investors are aware of the Olympus signing, as PTSC has not yet put out their PR (which should coming in the morning). The only ones who KNOW are those witty enough to read this board or to check the Alliacense site for the news. I suspect this is a minority.
I too hope to see more news this week. Financials would be nice, and another signing would be great.

STIPULATION AND [PROPOSED] ORDER FOR LEAVE TO FILE A FIRST AMENDED COMPLAINT FOR PATENT INFRINGEMENT
The parties and Patriot Scientific Corp. (“Patriot”), through their respective undersigned counsel, hereby stipulate and agree pursuant to Federal Rule of Civil Procedure 15(a) that:
1) Plaintiff Technology Properties Limited, Inc., (“TPL”) and Patriot are filing herewith a
First Amended Complaint for Patent Infringement, a copy of which is attached hereto as Exhibit A,
adding Patriot as a plaintiff in this action, pursuant to Rule 15 of the Federal Rules of Civil
Procedure;
2) Patriot agrees to be bound by all prior orders of this Court, including the First
Amended Docket Control Order, Amended Discovery Order and Revised Protective Order. With
Case 2:05-cv-00494-TJW Document 110-1 Filed 09/01/2006 Page 1 of 6

respect to any deadlines that have already passed, Patriot will comply with those deadlines as soon as
is practicable and will not seek to delay the prosecution of this action.
3) Patriot adopts TPL’s Preliminary Infringement Contentions and joins in TPL’s motion
to amend the Preliminary Infringement Contentions.
4) The parties and Patriot agree that the First Amended Complaint shall be deemed
served on the present defendants in this action on the date of filing of the First Amended Complaint
pursuant to this order;
5) The parties and Patriot agree that defendants’ previously filed answers to the original
complaint shall be deemed responsive to the First Amended Complaint.
6) This stipulation shall be without prejudice to any rights, claims, or defenses that any
party and Patriot may have against each other.
