The Federal Trade Commission named the two companies in an e-mailed statement today. The bidding process is being reviewed by the Antitrust Division of the Justice Department, according to a person familiar with the situation who declined to be identified because the process isn’t public.
Apple Inc. (AAPL) got similar approval yesterday to bid for Nortel’s patents in an auction set for June 27. Nortel, a Canadian phone-equipment maker that filed for bankruptcy in 2009, agreed to sell about 6,000 patents to Google Inc. (GOOG) for $900 million unless a competitor bids more at the auction.
A call to the New York office of game developer Rockstar Games to ask if Rockstar Bidco is a related entity was referred to an e-mail address for press enquiries. No one immediately responded to an e-mail seeking comment.
Chuck Mulloy, a spokesman for Santa Clara, California-based Intel, declined to comment.
BlackBerry smartphone maker Research In Motion Ltd. (RIM) and Ericsson AB are also weighing bids, people familiar with those companies’ plans have told Bloomberg News. RPX Corp., a San Francisco-based patent-buying firm, is also considering a bid, Andrew Kent, an attorney for the company, said at a bankruptcy court hearing last month.
Nortel, based in Mississauga, Ontario, on June 16 delayed the auction for a week, citing a “significant level of interest.” Some Nortel auctions have lasted more than 24 hours, with several rounds of bidding. The sales have raised about $3 billion to pay the company’s creditors to date.
In one of its last asset sales in a drawn-out bankruptcy break-up, Nortel is selling 6,000 patents and patent applications, ranging across its whole spectrum of expertise in wireless, data and optical networking, voice, Internet, semiconductors and other technologies.
The sale could fetch US$1.5-billion, said Josh Walker, CEO of Lex Machina Inc, which consults on intellectual property litigation.
“This is one of the largest and one of the most strategically significant ones,” he said.
The most prized patents in the collection relate to next-generation mobile broadband technology used in emerging 4G standards such as long term evolution.
Mike Lazaridis, the co-chief of Canada’s Research In Motion, once described these patents as a “national treasure.”
But RIM will likely be outbid by deep-pocketed mobile companies including Google and Apple.
A source at chipmaker Intel called the portfolio a “gold mine” for its own push into mobile. Several sources have said likely bidders also include Sweden’s Ericsson and U.S.-based RPX Corp, which licenses patents on behalf of member clients for a fee.
Chinese network equipment maker ZTE has also expressed interest in the LTE portion.
The auction, almost certainly the largest public sale of its kind, comes amid strong mobile industry growth — and soaring litigation — as relative latecomers Apple and Google seek to bolster weaker collections of patents versus rivals.
Walker said a US$1.5-billion price tag was not excessive, considering licensing and royalty deals can cost a company between US$500-million and US$1-billion.
The sale of Nortel’s patents could take days to thrash out and must then be approved by a Delaware bankruptcy court on July 11. The court will likely hear objections from losing bidders and companies that reached licensing deals with Nortel while it was solvent, such as Microsoft.

In earlier days, tech companies would quietly hash out licensing deals to share their technical know-how, and those with the most patents got the best terms.
This history makes it easier to value the radio patents, which Morgan Keegan analyst Tavis McCourt described as “a much more mature market for royalties” than exists for some of the other Nortel patents.
But the ground rules are being rewritten as smartphones and tablet computers promise new riches and bring new players into the wireless industry.
“You need to add in a fear premium from most of the people you hear that are attached to this auction,” said a source close to the situation. “I think for certain people it would be a bad thing if other people got their hands on these patents.”
Google opened bidding in April with a US$900-million “stalking horse” bid, and said it hopes the patents will ward off litigation from more established rivals.
Its Android mobile software has attracted a lawsuit from Oracle, while handset makers using the software have also been sued by both Apple and Microsoft, which claims an existing, perpetual license to Nortel patents.
Microsoft receives money from deals reached with some Android handset makers but is pressing for more.
The industry’s fear of litigation could help RPX, which can reduce risk for its customers — including major chip and handset makers, network builders and carriers — by ensuring they are licensed to use the related technologies.
The patent sale is a last gasp for Nortel, which was once Canada’s biggest company by market capitalization before imploding as the tech bubble burst. It filed for bankruptcy protection in January 2009.
Nortel raised around US$3.2-billion for creditors by selling business units since then.

Der Namensteil "Bidco" deutet darauf hin, dass es sich um eine nur für diese Auktion gegründete Firma handeln könnte: "the bid" ist ein Gebot, "to bid" heißt "bieten"; "LP" könnte für "Limited Partnership" stehen. Die US-Mobilfunkfirmen Sprint und Airgate Wireless waren mit dem gemeinsamen Unternehmen "SVC BidCo L.P." als Bieter in einer Frequenzauktion erfolgreich.
Unter dem Label Rockstar Games produziert der Spielehersteller Take-Two Interactive unter anderem "Grand Theft Auto". Rockstar Games hat Fragen zu einer möglichen Beteiligung an Rockstar Bidco LP bislang nicht beantwortet, schreibt der kanadische Ottawa Citizen. In einem Blog-Beitrag spekuliert die auf geistiges Eigentum spezialisierte Firma IPva, dass hinter dem geheimnisvollen Unternehmen Intellectual Ventures stecken könnte. Gründer und Leiter dieser Firma, die sich mit Erfindungen beschäftigt, ist der ehemalige Microsoft-CTO Nathan Myhrvold.
Google könnte die Nortel-Patente für 900 Millionen US-Dollar kaufen, wenn in der am 27. Juni stattfindenden Auktion kein höheres Gebot abgegeben wird. Unklar ist allerdings, ob die Rechte nur als Gesamtpaket oder auch in kleineren Einheiten abgegeben werden sollen. Bislang steht Apple als weiterer Teilnehmer fest, IPva nennt als mögliche zusätzliche Bieter den Netzwerkausrüster Ericsson, den BlackBerry-Hersteller RIM, den chinesischen Telekomausrüster ZTE "oder ein chinesisches Konsortium" und die auf Patentstreitigkeiten spezialiserte RPX. Die Verkäufer haben bis zu fünf Tage Zeit, über die Annahme der abgegebenen Gebote zu entscheiden. (ck)

in diesem artikel stimmen, dann schauts ja noch viel besser aus, als ich bisher angenommen habe... hier ist wieder die rede von "nur" 3 mrd dollar schulden - und das ist durchaus eine nicht unrealistische summe, wenn man bedenkt um was es geht (zukunftstechnlogien - vormachtstellung) und welche firmen auf die patente bieten.
allerdings habe ich auch schon ganz andere zahlen gelesen (die ich aus psychologischen gründen erst gar nicht nennen will ^^) - wie auch immer, es wird heiß!

Spiegelt die Situation und die Phantasie wieder. Besonders schön fand ich die Passage vom "Tenbagger", falls es tatsächlich zu einer extremen Versteigerungen kommt. Alleine die Daytrader könnten das Teil bereits morgen oder Dienstag gen Norden katapultieren. Bin sehr aufgeregt...brauche jetzt einen guten trockenen Rotwein.
