U.K. Court of Appeal Rules Affymetrix Owns OGT Patent License


SANTA CLARA, Calif., Nov 2, 2000 /PRNewswire via COMTEX/ -- Affymetrix, Inc. (Nasdaq: AFFX) said that the U.K. Court of Appeal unanimously held today that Affymetrix' purchase of the Beckman Coulter microarray business transferred a license to the "Southern Patents." The decision reversed an April 2000 finding of the U.K. High Court in litigation brought against Affymetrix by Oxford Gene Technology Limited (OGT).
Specifically, Lord Justice Aldous, who delivered the leading judgment, concluded "Affymetrix has a license as a result of the purchase of the business of Beckman."
Vern Norviel, Senior Vice President and General Counsel of Affymetrix, commented, "We welcome the decision by the Court of Appeal and will continue our mission of providing GeneChip(R) products and other enabling genetic analysis tools to scientists working to understand the human genome and help cure disease."
"In light of this decision, Affymetrix now looks forward to a determination in the U.S. District Court in Delaware that its current products are not covered by any valid OGT claim, in which case Affymetrix may no longer need to pay royalties to OGT," said Phil McGarrigle, Chief Intellectual Property Counsel of Affymetrix. "Furthermore, our freedom to operate under OGT's patents is now clear and unequivocal, if we should need it."

dass die Affies damit endgültig die Bodenbildung geschafft haben und sich ein stabiler Aufwärtstrend bildet,-  fundamental meiner M. durchaus berechtigte Hoffnung.

schaut euch mal die kurse an! die news haben offensichtlich doch einen gewaltigen einfluss - ich gehe davon aus, dass an der nasdaq AFFX heute endgültig nach norden dreht.

nasdaq vorbörslicher Handel genauso aussagekräftig wie unsere L&S-Kurse - na Hauptsache die Richtung stimmt.  

ich damit rechne, daß dies auch meinen anderen Genchip-Werten gut tun wird.  

welche Genchip-werte gibt's denn da noch (Affx hab ich gestern für 65€ geordert - hab ich auch gepostet).
Kauf ich jetzt noch eine paar!

habe bei L&S geschaut: Kurse wie gestern  etwa 70 Euro
wollte über L&S kaufen:  ask war aber bei 83 Euro !

bestätigung kam grade durch.  

Nachdem die erste Patentstreitigkeit zu gunsten von AFFX ausgehen wird, werden wohl die positiven Stimmen zunehmen. Die Patentunsicherheiten lasteten lange genug auf den Kurs.

Ich muss aber ehrlich gestehen, dass ich die heutige Meldung fundamental nicht wirklich abschätzen kann. Klar ist es positiv, wenn man eine Lizenzstreitigkeit gewinnt.

Aber rechtfertigt das +10, +20 oder +50%  -muss ehrlich gestehen - ich habe keine Ahnung !

Überlege daher fast kurzfristig den Gewinn mitzunehmen - bei 77,5 USD wäre es immerhin 20% bei 100 Stück.

Ich werde aber warscheinlich dennoch halten und mich heute abend ärgern, wenn AFFX wieder unter 70 zu stehen kommt.

Aber ich bin einfach begeistern von diesen Chips !

na wenn!!! hab jetzt für 78 geordert... man weiß ja nie?  

Ich bin momentan (neben AFFX) noch in Incyte, Nanogen und Sequenom investiert. Hyseq und Orchid stehen auf der Watchlist. Bei all diesen Werten muß man etwas traden oder besser gesagt umschichten - also Gewinne mitnehmen und in die gerade wieder günstig gewordenen investieren. Das klappt leider nicht immer. Fundamental gesehen ist AFFX und Incyte wohl auch ein gutes Langfristinvestment.  

Schluss mit der Euphorie nur noch 62 USD ????

klar, dass die news überbewertet sind - die momentane kurssteigerung ist ja auch nur in europa zu verzeichnen und die umsätze sind vergleichsweise (nasdaq) eher lächerlich. ich habe allerdings seit einigen tagen beobachtet, wie die an der nasdaq gelaufen sind und m.e. hat sich da ganz klar eine trendwende abgezeichnet. bin fast sicher, dass an der nasdaq heute auch noch kräftige kursgewinne zu erwarten sind (und dann fallen sie auch hier nicht wieder runter).

ist für mich nichts zum zocken, sondern ein mittel- bis längerfristiger gewinner (genauso wie Human Genome - auch wenn die von förtsch empfohlen wurden, wie ich gestern erst gelernt habe).

also mir beginnen die biotechs zu gefallen - ich guck mir jetzt nochmal QGENF, AMGN, GENZ, MEDI und cambrige/CAT/uk genauer an.

Seit dem Kauf meiner Affx bin ich erstmals wieder bei meinem Einstiegskurs angelangt. Was meint ihr, geht's noch weiter rauf. Ich habe leider keine genauen Erkentnisse über die Konkurrenzsituation bei Affx ist. Wäre für eine Einschätzung dankbar.

Einschätzung:

kurzfristig keine Ahnung, meine persönliche Hoffnung/Einschätzung : 80 bis 100 USD bis Jahresende (je nach "Stimmung"). Nächstes Jahr Kursverdoppelung - diese aber fundamental untermauert.

Für mich ein mich ein klarer Outperformer für einige Jahre.

Ich hatte gestern die Kauf-Order schon eingetippt und dann doch nicht weggeschickt. (ich hab zu wenig cash)

So ist das Leben. Gute Sachen zieh ich einfach nicht durch.
